IEBC to hear cases against Kethi and Kaloki tomorrow

The IEBC Nomination Dispute Resolution Committee will sit on Friday to determine the viability of Jubilee and Cord candidates to run for the Makueni Senate seat.
The committee announced yesterday that it has received two complaints against Kethi Kilonzo (Cord) and Philip Kaloki (Jubilee).
"We have received two complaints challenging the nomination of Philip Kaloki nominated of NARC and Kethi Kilonzo," read a notice signed by committee chair Thomas Letangule.
"The Commission Nomination Dispute Resolution Committee shall hear these complaints on Friday July 5 at 10:00am in the Milimani law courts."
The notice is addressed to the Peoples Party of Kenya, Wiper, Narc, URP and the two candidates.
Others are Secretary General of PPK John Kihiko, PPK member Joseph Mwanza and three voters Agnes Ndetei, Rodah Maende and Phyles Nthenya.
Kihiko, Mwanza, Ndetei, Maende, Nthenya and PPK are the complainants against Kethi while Kihiko, Mwanza and PPK have launched distinct complaint against Kaloki.
Ndetei, Maende and Nthenya said Kethi is not a registered voter and should not have been cleared by the IEBC.
In their separate complaint on Kethi, Kihiko, Mwanza and PPK said Kethi only became a member of Wiper on June 8 and was therefore not nominated by Wiper 45 days before the election as required by Section 13 of the Elections Act.
"A Nairobi registered voter cannot vote in Makueni county," they said.
The complaint against Kaloki said his nomination papers were first rejected by the returning officer Salad Boru on June 26 but were accepted the following day, a date reserved for a different set of candidates.
Yesterday, Makueni MP and Cord lawyer Daniel Maanzo said the complaint against Kethi is an exercise in futility as the committee cannot legally review the commission decision. He said the matter can only be lodged in the High Court.
The two are the front runners for the by-election slated for July 22.
The by-election was occasioned by the death of Kethi's father Mutula Kilonzo on April 27.
