Kimaiyo barred from making appointments

NAIROBI, KENYA: The High Court has stoppedInspector General David Kimaiyo from making any appointments or deployments within the National Police Service until a suit filed against him is heard and determined.
Justice Weldon Korir also allowed the International Centre for Peace and Conflict ( ICPC) to institute Judicial Review proceedings to compel the National Police Service Commission to remove Kimaiyo from office for violating the Constitution.
The judge also allowed ICPC to initiate proceedings to nullify the appointment of 47 County Police Commanders who were appointed by Kimaiyo.
ICPC has sued the Attorney General, Kimaiyo and the chairman of the Chairman, National Police Service Commission (NPSC).
In June, Kimaiyo appointed the County Commanders, a move that seemed to go against NPSC’s plan to recruit officers to the same position.
The Johnstone Kavuludi-led NPSC had advertised the positions and sought qualified officers to apply in accordance with the law.
In the suit, ICPC alleges that the appointment of County Police Commanders was a violation that needs to be stopped as it risked setting a bad police precedent in the public service and National Police Service.
“National Police Service Commission had during the month of May, advertised for vacant positions for recruitments in the County Police Commanders. The said process should therefore be allowed to be completed,” ICPC stated.
The case will be mentioned on July 15 for further directions.
