Mutula Kilonzo Jnr's candidature for the Makueni Senate by election has been challenged before the Independent Electoral and Boundaries Commission.
In an advertisement in the local dailies, IEBC said that a complaint has been lodged with its dispute resolution committee challenging the decision by the Makueni Returning Officer to accept Mr Kilonzo Jnr's nomination.
The advert signed by Nominations Dispute Resolution Committee chairman Thomas Letangule set the hearing for 2.30 pm Tuesday.
"Take notice therefore that the Commission Dispute Resolution Committee shall hear this complaint on Tuesday 23rd July, 2013 at 2.30 .pm at the Commission’s 6th Floor Boardroom, Anniversary Towers,” Mr Letangule said.
The chairman issued the notice to Mutula Kilonzo Jnr, Wiper Democratic Movement, Michael Kimani Horeria and the Returning Officer Salad Boru who are parties to the dispute to appear for the hearing or send their representatives.
He warned that the committee will continue with the proceedings even if the parties failed to attend.
Last week, the High Court granted Wiper the right to nominate another candidate for the Makueni by-election slated for Friday.
This was after the court upheld Mr Letangule’s committee's decision to revoke Kethi Kilonzo’s nomination on grounds that she was not a registered voter.
Former assistant minister Agnes Ndetei has also filed an appeal in court seeking to block Mr Kilonzo Jnr from contesting.
Despite his late entry to the campaign, Mr Kilonzo Jnr is seen as the favourite to succeed his late father Mutula Kilonzo.
Campaigns are in hot gear with Jubilee’s candidate Philip Kaloki who is vying on a Narc ticket, Harun Mwau of Party of Independent Candidates of Kenya, Jane Kitundu of Labour Party of Kenya and an Independent Party candidate Urbanus Muthoka battling it out for the seat.
The seat fell vacant following the death of former Wiper Democratic Party secretary general Mutula Kilonzo in April.
IEBC officials were locked up in a meeting on Monday to find ways of including the name of Mutula Kilonzo Jnr in the ballot paper after it was left out by a UK printer.
